1.0 EasyGO Fare Card Program Terms and Conditions
This is the agreement between you (“you” “user” or “your”) and The Regional Municipality of Waterloo who owns and operates Grand River Transit (“GRT”, “we”, “us” or “our”) for the EasyGO Fare Card Program and Services.
You may use cash to pay your fare and choose not to participate in the EasyGO Fare Card Program when taking transit in the Region of Waterloo. If you visit this Site or otherwise choose to use the Services provided by GRT under the EasyGO Fare Card Program (including but not limited to EasyGO Fare Cards, Fare Products, or the Sites which we link to these Terms, and GRT customer service) you agree that your use will be subject to and governed by these EasyGO Fare Card Program terms and conditions (“Terms”). If you are under the age of majority in your jurisdiction of residence, you must have the consent of your parent/legal guardian to these Terms to use the Site and/or the Services.
By activating or using your EasyGO Fare Card, or using the Services we provide in association with these Terms, you agree to the terms and conditions provided in these Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink and to comply with all applicable laws and regulations as they may change from time to time.
These Terms do not apply to other smart cards provided by third parties that may be used for fare payment on GRT services (e.g. student cards that are loaded with a U-Pass.) Third-party cards will be governed by the terms of use established by the card’s provider. GRT is not responsible for such terms or such third party cards.
2.0 Definitions
As used in these Terms, the following terms shall have the meanings indicated in this section.
“Account” means the record of a Cardholder’s information and EasyGO Fare Card details, created for the purpose of registering a card and accessing certain features associated with the card.
“Autoload” refers to an automatic top up to the Stored Value on your Card when the balance in your Account goes below a minimum threshold you have set and charging the cost of such top up against the Cardholder’s credit card.
“Autorenewal” refers to automatically adding a pass to an EasyGO Fare Card and charging the cost of such pass against the Cardholder’s credit card.
“Business Account” means an Account held by an entity other than an individual customer, as approved by GRT, that purchases EasyGO Fare Cards and Services for distribution to other participants such as its employees, students or other program participants according to the terms of an agreement with GRT.
“Business Card” means an EasyGO Fare Card issued to a Business Account for distribution to individuals who are eligible to participate in the Business Account’s program according to the terms of an agreement with GRT.
“Cardholder” means an individual who has obtained or been issued an EasyGO Fare Card.
“Card Reader” means an electronic sensor that reads compatible smart cards including but not limited to the EasyGO Fare Card and Multi-ride Card that is built into a fare payment device aboard a GRT vehicle or located at a GRT light rail station platform.
“Concession Card” means an EasyGO Fare Card which has been issued to an individual showing proof of eligibility for a reduced fare. All Concession Cards are Registered Cards.
“Customer Service Centre” means a terminal, kiosk, or other location that GRT has designated as providing customer service for the EasyGO Fare Card Program. The current Customer Service Centres are listed on the Site.
“EasyGO Fare Card” or “Card” means a reusable smart card that can be used to pay for transit services provided by, or in partnership with, GRT.
“EasyGO Fare Card Program” means the program described in these Terms for fare payment on transit services, including without limitation any equipment, systems, facilities, EasyGO Fare Cards, Multi-ride Cards, Fare Products, the Sites, data, information, and any products and services associated therewith.
“Site” means the EasyGO Fare Card site at www.grt.ca/farecard and any websites to which we link these Terms, including the web portal for managing Cards at www.grteasygofarecard.ca.
“Fare Products” means any transit fare payment offered for sale as part of the EasyGO Fare Card Program, including without limitation monthly passes, period passes and Stored Value.
“Fare Structure” means the list of Fare Products, fare prices and eligibility criteria as amended from time to time and listed at www.grt.ca/fares.
“Fare Vending Machines” means the self- serve machines at select locations that allow customers to pay for and obtain a single light rail fare, EasyGO Fare Cards, Multi-Ride Cards, and load fare products on their EasyGO Fare Card and/or check their Card balance.
“Multi-ride Card” means a disposable paper smart card that can be loaded one time with pre-paid rides.
“My EasyGO Account” means an online Account created by any person using the EasyGO Fare Card website to manage their Card.
“Personalized Card” means an EasyGO Fare Card which bears the Cardholder’s photo and has been issued to an individual showing proof of eligibility. All Personalized Cards are Registered Cards.
“Registered Card” means an EasyGO Fare Card that has been successfully linked to a specific Cardholder’s Account through the completion of the registration process as outlined under Section 8.0 of these Terms.
“Retailer” means a business or other entity that, under an agreement with GRT, is equipped with a device at which Fare Products may be purchased and/or loaded on an EasyGO Fare Card.
“Services” means our provision of the EasyGO Fare Card Program, including without limitation, EasyGO Fare Cards, Multi-ride Cards, Fare Products, or the Sites which we link to these Terms, and GRT customer service regarding the EasyGO Fare Card Program, visiting our Site or otherwise using the services made available through the Site including but not limited to making a purchase from us.
“Stored Value” means an electronic equivalent of cash stored on an EasyGO Fare Card from which fare payments are deducted.
“Street Team” means the mobile GRT promotions team who are able to issue and load EasyGO Fare Cards.
“Unregistered Card” means a EasyGO Fare Card that is not linked to any Cardholder’s Account.
3.0 Privacy and Account Information
Any Personal Information you provide in association with the EasyGO Fare Card Program and/or the Services is collected, used and disclosed in accordance with the Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. M.56. as amended or replaced from time to time, and with the EasyGO Fare Card Privacy Statement. The EasyGO Fare Card Privacy Statement can be viewed at www.grt.ca/farecard.
You certify that all information provided by you to GRT is correct, accurate, up-to-date and complete, and that you will notify GRT in the event of any changes to such information. We are not responsible for your failure to comply with this requirement.
4.0 Fare Products
You may load Fare Products onto your EasyGO Fare Card. These Fare Products are a prepayment of fares on transit services provided by, or in partnership with, GRT. EasyGO Fare Cards are not, and do not represent an “account” or a “deposit” of money or money’s worth, and Fare Products and Stored Value are not “money”. You may not redeem EasyGO Fare Cards, Stored Value, and/or Fare Products for money or for any product or service other than a transit service which participates in the EasyGO Fare Card Program.
The EasyGO Fare Card is a type of fare media and does not entitle you to a specific fare price or Fare Product. GRT may, at any time and in its sole and absolute discretion, change the Fare Structure and any fare prices and the availability and eligibility criteria for any or all Fare Products.
5.0 Obtaining an EasyGO Fare Card
Adult EasyGO Fare Cards may be obtained from customer service at a designated Customer Service Centre, from selected Retailers, from the Street Team, and from Fare Vending Machines. Concession Cards and Personalized Cards must be obtained at a designated Customer Service Centre or from the Street Team. Concession Cards and Personalized Cards will be issued to Cardholders eligible for discounted Fare Products in accordance with GRT’s then current Fare Structure.
When you obtain an EasyGO Fare Card, you agree to pay GRT the issuing fee outlined in the then current Fare Structure. The term of each EasyGO Fare Card is from the date it is issued to the expiry date of the Card. The issuing fee may be subject to change, at the sole and absolute discretion of GRT. GRT may, in its sole and absolute discretion, choose to waive or reduce the issuing fee for new EasyGO Fare Cards during special promotions. Sales of EasyGO Fare Cards and Fare Products are final and non-refundable. EasyGO Fare Cards are non-transferrable.
6.0 Using an EasyGO Fare Card
When you wish to ride GRT and use your EasyGO Fare Card, tap the EasyGO Fare Card on a GRT Smart Card reader built into a fare payment device aboard a GRT vehicle or located at a GRT light rail station platform, or such other payment device as GRT may make available from time to time. The specific device you must tap may vary by vehicle, platform, and stop. When you tap your EasyGO Fare Card, the system calculates and deducts the fare from the Stored Value on your Card, or validates that an active pass is loaded on your Card. To the extent the Stored Value remains on your EasyGO Fare Card is not sufficient for the fare or if the system is unable to validate an active pass or deduct the stored payment from Stored Value then you are required to make full fare payment by a means other than the EasyGO Fare Card, subject to the remainder of these Terms. An EasyGO Fare Card may not be used for partial payment.
You can transfer between GRT vehicles in accordance with the provisions set out in GRT’s Fare Structure.
We may not authorize a transaction using an EasyGO Fare Card if: (a) the Stored Value on your Card is insufficient (except as set out below); (b) your EasyGO Fare Card Account or EasyGO Fare Card has been suspended or closed; and/or (c) your EasyGO Fare Card has been reported lost or stolen.
If your EasyGO Fare Card has been registered and has a remaining Stored Value (and none of the events set out in (b), or (c) in the preceding passage have occurred), you may run a negative balance to pay for one trip equivalent to one ride on a GRT vehicle, plus a 90-minute transfer. This negative balance will be deducted from your Card the next time you add Stored Value to your Card.
7.0 Checking your EasyGO Fare Card balance and history
You can check your Card balance and recent transaction history at Fare Vending Machines and by visiting customer service at a designated Customer Service Centre.
If you have registered your Card and created a My EasyGO Account, you can also check your balance and transaction history online.
8.0 Registering an EasyGO Fare Card
Registering your EasyGO Fare Card allows you to:
- Report a lost or stolen Card, have the Card blocked, and have your remaining balance transferred to a replacement Card.
- Set up an Autoload or Autorenewal of Fare Products on your Card.
- In accordance with section 6.0, run a negative balance equal to the price of one trip equivalent provided the initial balance is not $0 or a negative balance.
- Access your Card’s products, balance and transaction history online if you have also created a My EasyGO Account.
You can register your Card in person at a designated Customer Service Centre, or online through the Site. To register your Card online, you will be required to create a My EasyGO Account.
Concession Cards and Personalized Cards, which can be loaded with discounted Fare Products, must be registered when they are issued. Customers with Concession Cards and/or Personalized Cards may choose to set up a My EasyGO Account, but are not required to.
9.0 Adding Fare Products to the EasyGO Fare Card
EasyGO Fare Cards can be loaded with Stored Value and/or up to 2 passes. Fare Products can be added to an EasyGO Fare Card in person or online.
In person: You can add Fare Products to your EasyGO Fare Card at the customer service counters at a designated Customer Service Centre; at authorized Retailers; and/or at Fare Vending Machines. Fare Products will be available on your EasyGO Fare Card immediately.
Online: You can load Fare Products online through the Site using your credit card or debit card. You can authorize a one-time transaction or set up an Autoload or Autorenewal. Autoload or Autorenewal can only be set up if you have created a My EasyGO Account (See section 9.1). Fare Products loaded online can take up to 48 hours to be added to your EasyGO Fare Card.
You may purchase Stored Value in full dollar increments with a minimum of $10 load per transaction. The maximum amount of Stored Value that can be held on an EasyGO Fare Card at any time is $100.
All payments shall be made to GRT or to a Retailer for Fare Products that are loaded onto an EasyGO Fare Card. The electronic record in the EasyGo Fare Card Program shall be conclusive evidence of the Stored Value that was loaded onto an EasyGO Fare Card and remains unused or unexpired.
9.1 Autoload and Autorenewal
If you have registered your EasyGO Fare Card and created a My EasyGO Account, you can set up an Autoload or Autorenewal on your Card.
An Autoload will top up the Stored Value on your Card when the balance in your Account goes below a minimum threshold. When the Stored Value goes below the minimum threshold, your Account will be automatically topped up with an amount of your choosing (subject to these Terms), and your credit card will be charged. The minimum threshold is $10. The minimum amount of Stored Value that can be added with each Autoload is $10.
You can also set up automatic renewal of your transit pass. The pass set on your Card will be automatically loaded on your Card and your credit card will be charged. Provided there is no issue with payment, your pass will be activated on the first day of the pass period. Autorenewal may not be available for all transit passes.
You may cancel your Autoload or Autorenewal by signing into your Account.
9.2 Changes to credit card information
If your credit card information changes, you must update your My EasyGO Account at least 24 hours in advance of any Autoload or Autorenewal transaction in order to prevent disruption to your Autoload or Autorenewal.
If an Autoload or Autorenewal transaction cannot be processed for any reason, such as your credit card being declined, the system will make two more attempts to process the transaction. If the transaction is not successful after three attempts, the Autoload or Autorenewal will be suspended. You will be sent a message notifying you that the transaction was not completed and your Card could not be loaded. You will be prompted to manually load your Card by going to the Site, or to a designated Customer Service Centre.
You will need to set up a new Autoload or Autorenewal by updating your My EasyGO Account with a new credit card, or re-activate your existing Autoload or Autorenewal by contacting GRT customer service when the issue with your credit card has been resolved.
The Cardholder is responsible for any transit fares and/or other charges incurred in the event an Autoload and/or Autorenewal transaction fails for any reason.
9.3 When Fare Products become available

9.4 EasyGO Fare Card Billing errors and corrections
GRT reserves the right to correct the Stored Value on your EasyGO Fare Card in the event of any clerical, billing, accounting, or other error. This may include the addition or removal of Stored Value from a Card. We shall have no liability for any such error. You should monitor your transactions and Stored Value and notify us if you believe there is an error.
10.0 Lost, stolen or damaged EasyGO Fare Cards
You are responsible for taking all reasonable precautions to protect your EasyGO Fare Card from being defaced, altered, damaged, lost or stolen. The individual Cardholder or Business Account to whom a Card is issued bears the risk of loss if an EasyGO Fare Card is lost, stolen or damaged, up to the point where a Registered Card is blocked (Please see Section 11 below for how long it takes to block a Card). A lost, stolen or damaged EasyGO Fare Card may remain valid and any GRT Fare Products loaded on the Card may continue to be used to pay for transit services until the Stored Value and/or passes has been used up or expires. However, registered EasyGO Fare Cards may be blocked from further use and the balance transferred to a new Card in accordance with Section 11.0 below.
11.0 Blocking and replacing Registered Cards
If your Registered Card is lost or stolen, you should block your Card or report it to GRT customer service as soon as possible. Blocking a Registered Card prevents it from being used and protects your balance. An Unregistered Card cannot be blocked or replaced.
Online: If you have created a My EasyGO Account, you can block your Card by logging into your Account. Online blocking is available 24 hours per day, seven days per week.
In person: You can report a lost or stolen EasyGO Fare Card in person at a designated Customer Service Centre during operating hours. Visit https://www.grt.ca/en/about-grt/contact-us.aspx to see the hours of operation of the Customer Service Centres.
By phone: You can report a lost or stolen EasyGO Fare Card by calling customer service at 519-585-7555 24 hours per day, seven days per week. It may take up to 2 business days to block a Registered Card following a call to customer service.
To block a Card in person or by phone, you will need to provide your name and address, and verify your identity.
After a Card is reported lost/stolen, it will be blocked and will no longer be accepted. Please note that it may take up to 48 hours after you report your Card lost or stolen on the Site or at a designated Customer Service Centre, or up to 2 business days after you report your Card lost or stolen by phone for the block to take effect. GRT is not responsible for any use of your Card or Stored Value before you report your Card lost or stolen, or during the 48 hours after you report your Card as lost or stolen on the Site or at a designated Customer Service Centre, or during the 2 business days after you report your Card lost or stolen by phone.
Once a Card has been blocked, it is deactivated and cannot be reactivated or used again. You will need to obtain a replacement Card and have any Fare Products transferred to your new Card. Replacement Cards will be subject to an issuing fee. You will need to provide proof of identification in order to transfer your balance to a new Card.
You should not delete a lost or stolen Card from your My EasyGO Account until a replacement Card has been issued, linked to your Account, and the balance transferred to the new Card. If you delete a lost or stolen Card from your My EasyGO Account, GRT will be unable to verify the balance and cannot transfer your balance to your new Card.
12.0 Business Accounts and Business Cards
An entity other than an individual customer, may apply to enter into a Business Account agreement with GRT to purchase EasyGO Fare Cards and Fare Products for distribution to other participants such as its employees, students, and/or clients. Subject to the terms of the agreement with GRT the Business Account remains the owner of the EasyGO Fare Cards after distribution.
12.1 Loading Fare Products on Business Cards
The Business Account may load Fare Products onto the associated Cards online using the My EasyGO Account. A Business Card holder can load Fare Products in person at a designated Customer Service Centre or Fare Vending Machine. However, a Business Card holder can only load the regular Fare Products allowed by their Card type.
12.2 Business Card registration
A Business Account may choose to register the Cards it distributes. If the Business Account has registered the Card distributed to you, you will not be able to register it yourself. However, if the Business Account has not registered the Card, the Business Card holder may register it following the process in Section 8.0.
12.3 Blocking and replacing Business Cards
If your Business Card is lost or stolen, you should report it to the Business Account (employer, school, social service agency, or other entity) that distributed it to you. The Business Account can initiate a block on your Card. The Business Account is also responsible for issuing a replacement Card, if necessary.
13.0 Defective EasyGO Fare Cards
If you believe your EasyGO Fare Card is defective, you may seek to obtain a replacement Card at no cost if: (a) the Card is returned to GRT customer service at a designated Customer Service Centre within six (6) months of the date it was issued; and (b) the defect, as determined by a customer service representative in their sole discretion, was caused by a defect in design, material or workmanship and was not caused by misuse, intentional action(s), negligence or damage.
The defective Card must be returned to GRT customer service at a designated Customer Service Centre and will be blocked and deactivated. Any passes and/or Stored Value on the Card will be transferred to a replacement Card. A defective Card cannot be replaced online.
14.0 Expired EasyGO Fare Cards
EasyGO Fare Cards will expire in 5 years, unless designed to do otherwise by the requirements of a special fare program subject to additional terms that specify otherwise. All Cards that would expire in less than 5 years in accordance with any additional terms that apply to such Cards are required to be registered.
One month before your Card’s expiry date, you will see a reminder notification every time you tap your Card on a GRT device. It is your responsibility to obtain a new replacement Card before it expires.
If your Card is not registered, remaining Fare Products cannot be transferred. You should ensure that any Fare Products are used up before the expiry date.
If you have registered your Card, you can transfer any remaining Fare Products to a new Card. After your registered EasyGO Fare Card expires, any Fare Product remaining will be available for 24 months, subject to earlier expiry in accordance with the term of such Fare Product. Fare Products remaining on an expired EasyGO Fare Card cannot be refunded, but can be transferred to a new EasyGO Fare card in accordance with this section.
15.0 Closing your My EasyGO Account
You may close your My EasyGO Account at any time by clicking “Close Account”.
GRT reserves the right to terminate any Account, Card, this Agreement, and/or all or any part of the EasyGO Fare Card Program, at any time, at its sole discretion.
An Account is “inactive” from the date of its last use or transaction, such as use of an associated Card to pay a fare, or a load of a Fare Product such as Stored Value, including without limitation an Autoload, or Autorenewal. If your My EasyGO Account is inactive for a period of 2 years or more, we may end your access to the My EasyGO Account and close your My EasyGO Account. In such an event, all Stored Value or other Fare Products remaining in your My EasyGO Account shall expire and be non-refundable.
16.0 Retailers
No refunds will be made by GRT for any GRT Fare Products sold by a Retailer.
The Retailer, not GRT, is responsible for the collection, storage, transmittal, safekeeping and use of payments and any information you provide to the Retailer when you purchase GRT Fare Products from them or add Stored Value to an EasyGO Fare Card at a Retailer.
A Retailer may not block or replace a lost, stolen, damaged or defective EasyGO Fare Card.
17.0 Use, loss, stolen or damaged Multi-ride Cards
Multi-ride Cards can be presented for fare payment on GRT buses, GRT light rail transportation platform Card Readers, Fare Vending Machines or such other payment device as GRT may make available from time to time.
Store your Multi-ride Card carefully and use it properly to avoid damaging it. The Multi-ride Card cannot be replaced in the event it is lost, stolen or damaged. Damaged Multi-ride Cards may be invalidated or otherwise not usable, and GRT is not responsible for such Multi-ride Cards.
17.1 Obtaining, loading and expiry of Multi-ride Cards
Multi-ride Cards can be obtained from Fare Vending Machines, subject to availability. Multi-ride Cards can be loaded with a minimum of 5 and maximum of 15 rides. Multi-ride Cards are valid for 1 year from the date of issuing.
18.0 EasyGO Fare Cards and Multi-ride Cards ownership and use
Only GRT, a Retailer in the case of an EasyGO Card, or another authorized person may provide you with an EasyGO Fare Card and/or a Multi-ride Card. It is prohibited to deface, alter, duplicate or create a counterfeit EasyGO Fare Card and/or Multi-ride Card. You may not seek to load GRT products through any unauthorized means onto an EasyGO Fare Card, a Multi-ride Card or any unauthorized card. GRT does not honour defaced, altered, duplicated or counterfeit cards or otherwise unauthorized cards or products.
All EasyGO Fare Cards and Multi-ride Cards are and remain the property of GRT, and must be returned to GRT immediately upon request. Employees and authorized representatives of GRT have the authority to inspect, confiscate and/or demand the return of any EasyGO Fare Card and/or Multi-ride Card. GRT may deny services to, or require payment in cash from, anyone presenting unauthorized cards or products.
GRT reserves the right to suspend or deny any particular use of any element of the EasyGO Fare Card Program, including without limitation by blocking any EasyGO Fare Card, Multi-ride Card or Fare Products. We may do this if the Cardholder: (a) fails to comply with these Terms, Fare Structure/Fare policy, or any other applicable terms, policies, rules, laws and regulations; (b) a payment is not honoured due to non-sufficient funds or if a payment is rejected, negated or reversed for any reason; and/or (c) we believe that a Card has been altered, duplicated, counterfeited, stolen or used by an ineligible cardholder. If an EasyGO Fare Card is blocked/and or confiscated, the refund of any amount remaining on the Card shall be at the discretion of GRT and subject to such conditions as we deem fit including the deduction of any amount we determine is due or payable by the cardholder to GRT.
19.0 Optional Tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the Site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the Site (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and any additional terms we place on such new features and/or services.
20.0 Third Parties
Certain content, products and services available via our Services may include materials from third-parties.
Third-party links on this Site may direct you to third-party websites that are not maintained by or affiliated with us. We do not have any control over third-party links, nor are we responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. Your access and use of third-party websites, including any information, materials, products and services, is entirely at your own risk and discretion.
We are not liable for any direct, indirect, incidental, exemplary, punitive, consequential or other losses, harm, or damages of any kind whatsoever related to the access to, purchase, or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites or any information or reliance on any such goods, services, resources, contact or other transactions. You understand and agree that the Site’s Privacy Statement is applicable only while you are using this Site and our Services. Once you are linked to a third-party website, please review carefully the third-party's, terms of use, privacy statement and policies and practices and make sure you understand them before you engage in any transaction or provide any information. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
21.0 Comments, Feedback and Other Submissions

We are and shall be under no obligation: (a) to maintain any Comments in confidence; (b) to pay compensation for any Comments; or (c) to respond to any Comments. By providing us with any Comments, you grant us a world-wide, perpetual, irrevocable, transferable, sub-licensable, royalty-free, non-exclusive, and unrestricted license to copy, reproduce, adapt, transmit, edit, modify, or otherwise use, publicly display, distribute, translate and create compilations and derivative works from, any and all such Comments (in any format or media), and waive all moral rights in and to all such Comments.
We may, but have no obligation to, monitor, edit or remove any content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.
You agree that your Comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services, Sites, or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Comments. You are solely responsible for any Comments you make and their accuracy. We take no responsibility and assume no liability for any Comments submitted by you or any third-party.
22.0 Errors, Inaccuracies, Omissions
Occasionally there may be information on our Site or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or refuse or cancel your Account Fare Products, or any order placed if any information in the Services or on any related website is inaccurate at any time without prior notice including after you have submitted your order and/or your credit card (or other permitted payment method) is charged.
We undertake no obligation to update, amend or clarify information in the Services or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Services or on any related website should be taken to indicate that all information in the Services or on any related website has been modified or updated.
23.0 Prohibited Uses
In addition to other prohibitions as set forth in these Terms, you represent and warrant that you will not (nor permit anyone under your Account ) use the Site or Services: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to intentionally or unintentionally violate any applicable, international, federal, provincial regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload, post, email or otherwise transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services , or the Site, or other websites, or the Internet; (h) to collect, track, or store the personal information of other users of the Site and the Services without their express written consent; (i) use manual or automated software, devices, scripts, robots or other means to spam, phish, pharm, pretext, spider, crawl, or scrape the Site or Services without our permission; (j) for any obscene or immoral purpose; (k) to attempt or actually interfere with or circumvent the security features of the Site or the Services or any related website, other websites, or the Internet by any means (including but not limited to using administrator passwords or by masquerading as an administrator while using the Site) to gain unauthorized access to any portion of the Site, the Services, our computer systems, servers or networks or the Account of other users; (l) use bots or other automated methods to access the Site or the Services, add or download contacts, send or redirect messages, or perform other activities on the Site, unless explicitly permitted by us; (m) upload, post, email, or otherwise transmit to the Site: (i) any content that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); or (ii) any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation; or (iii) any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, alter, or limit the functionality of any computer software or hardware or telecommunications equipment or that imposes an unreasonable or disproportionately large load on the Site's infrastructure or limits the functionality of any of our, or any other third party’s computer hardware, software, networks, or hardware or telecommunications equipment; (n) upload, post, email or otherwise interfere with or disrupt the Site or servers or networks connected to the Site or any Services made available through the Site, including without limitation, attempting to interfere with the access of any other user, host or network, including without limitation, overloading, initiating, propagating, participating, directing or attempting any “denial of service”, “attacks”, “spamming”, “crashing”, or “mail-bombing” the Site or disobeying any requirements, procedures, policies or regulations of networks connected to the Site; (o) access, via automated or manual means or processes, to the Site or the Services for purposes of monitoring the Site's or the Service's availability, performance, security or functionality without our prior permission; or (p) engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Site or the Services.
We reserve the right to terminate your use of the Site, the Services or any related website and, if appropriate, make a referral to the relevant law enforcement authorities, for engaging in any of the prohibited uses.
24.0 Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent or warrant that: (a) your use of our Site, Services or the Content contained in the Site will be uninterrupted, complete, valid, suitable, timely, secure or error-free or meet your expectations or requirements in any way; (b) the results that may be obtained from the use of the Services will be accurate, beneficial or reliable; and (c) any defects in the Services or the Content will be corrected or that the Site or the servers that make it available are free of viruses or other harmful components. We are not liable for any inability to access the Site, your inability to conduct transactions due to unavailable or unreliable telecommunications, networks, or internet service providers, incompatible or malfunctioning equipment, or software you use for such access or otherwise.
You agree that from time to time we may remove the Services or portions thereof for indefinite periods of time or cancel the Services, in whole or in part at any time, without notice to you. You expressly agree that your use of, or inability to use, the Services is at your sole risk.
Any Services described on the Site are offered in jurisdictions where they may be legally offered for sale. The information on the Site is not an offer or solicitation to anyone in any jurisdiction in which an offer or solicitation cannot legally be made or to any person to whom it is unlawful to make a solicitation.
To the extent permitted by applicable law, the Site, the Services, any Content therein, and all information, products and service delivered to you through the Services and Site are (except as expressly stated by us) provided on an ”as is” and ”as available” basis for your use, and without any representation, warranties or conditions of any kind, either express or implied, statutory or otherwise including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, non-infringement or those arising out of course of dealing or usage of trade, are hereby disclaimed to the full extent permitted by law. You are solely responsible for any resulting damage to your computer system or loss of data as a result of your use of the Site, the Services or the Content.
GRT, its subsidiaries, affiliates, partners, retailers, and their respective elected officials, officers, directors, agents, licensors, service providers, subcontractors, suppliers, interns, employees, third party service providers, successors and assigns (collectively the “Releasees”) will not be responsible or liable for any injury, claim, delay, damage, loss, expense or inconvenience or any direct, indirect, incidental or exemplary or punitive, special , or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages whether based on contract, tort (including negligence) , strict liability or otherwise, from you or any other person arising from use of the Site, the Services, any Content therein, or any products procured using the Services, or for any other claims related in any way to your use of the Site, the Services any Content therein or any products , including without limitation: (a) if the EasyGO Fare Card Program does not work as expected for any reason, including any delay or failure in the processing of any transaction; (b) if we do not receive a notice from you or your instructions for any reason, or if we delay or fail to act on your instructions, for any reason; (c) if GRT does not process a transaction when your My EasyGO Fare Card has insufficient funds or if your My EasyGO Account has been suspended or terminated; (d) if there has been any failure or delay in providing a message to you, or if a message is given to a person other than you or not accessed by you; (e) your use or inability to use the Site, the Services or the Content and/or products thereon, or any website to which you hyperlink from the Site; (f) any third party claims that the use by you of the Site, the Services or Content and/or products thereon violates any third party intellectual property right or privacy right; or (g) any failure or performance of the Site, the Services or the Content and/or products thereon, including without limitation whether related to any errors, omissions interruption, defect, delay in operation or transmission of computer virus or line failure; based in contract, negligence, strict liability, fundamental breach, failure of essential purposes or otherwise, whether or not GRT had any knowledge, constructive or actual, that you might incur such damages. Without limiting the foregoing and for greater certainty, you agree that the Releasees will not be responsible or liable for any other delay, damage, loss, expense or inconvenience you or any other person may incur for any reason whatsoever.
You acknowledge and agree that GRT is providing to you, via the EasyGO Fare Card, Multi-Ride Card and/or Fare Products a method of payment only for travel on the transit system operated by, or in partnership with, GRT. The Releasees shall have no liability to you whatsoever in connection with any delay, damage, injury, loss, expense or inconvenience you or any other person may incur in connection with travel on GRT or while on the premises of GRT.
If some jurisdictions do not allow the exclusion or the limitation of implied warranties, or conditions or the exclusion or limitation of certain damages, in such jurisdictions, then GRT’s liability shall be limited to the maximum extent permitted by applicable law.
25.0 Indemnity
You agree at all times to indemnify, release, defend and hold harmless the Releasees from and against any claims, losses, judgements, actions, proceedings , damages, or demands, costs and expenses (including without limitation reasonable lawyer and other fees and disbursements) made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, any additional terms that apply to the products or services you use, your violation of any law or the rights of a third-party, your use or misuse of the Site, the Services or any Content.
26.0 Ownership
The Site, its content, all text, graphics, documentation, photos, software, logos, icons and other materials (collectively “Content”) are the property of GRT and/or GRT’s various third party service providers and/or licensors, and are protected under the copyright laws of Canada and other countries. No Content found on this Site may be copied, licensed, republished, distributed, displayed, sold, transferred, or modified without the express written permission of GRT and/or the applicable third party service provider or licensor. GRT makes no representations or warranties regarding such Content. GRT’s related trademarks, design marks and any other identifying marks of GRT displayed on the Site are the exclusive property of GRT. Other trademarks, design marks and any other identifying marks on this Site are trademarks of their respective owners. Nothing contained on this Site should be construed as granting, by implication or otherwise, any license or right to use any trademarks, except with the express written permission of GRT or such other party that may own the applicable trademarks, design marks and any other identifying marks.
27.0 Changes to Terms and Services
GRT retains the right, in its sole and absolute discretion, to terminate or modify any of these Terms and/or any other aspect of Services at any time, and without further notice or liability to Cardholders, Business Accounts, or any other person or entity. If we do this, GRT will post any amended Terms on our Site. As permitted by applicable law, any amendment will become effective at the time we post the amended Terms on our Site with an indication at the bottom of these Terms the date the Terms were last revised or as otherwise stated in any notice we choose to provide to you. It is your responsibility to check our Site periodically for changes. Use of your EasyGO Fare Card, Account, Multi-ride Card and/or Fare Products after the effective date of any change will be deemed to be your acceptance of the change.

29.0 General
Assignment: GRT may assign these Terms at any time without further consent or notice. You may not assign , convey, subcontract or delegate the obligations or benefits of these Terms to any other party.
Severability: The invalidity of any term or terms of these Terms shall not affect any other provision of these terms, which shall remain in full force and effect.
Language: It is the express wish of the parties that this Agreement and any related documents be drawn up and executed in English. Les parties conviennent que la présente convention et tous les documents s’y rattachant soient rédigés et signés en anglais.
Governing Law: These Terms, your use of the Site and any separate agreement whereby we provide you Services shall be governed by the laws of the Province of Ontario, and you irrevocably attorn to the exclusive jurisdiction of the courts of the Province Ontario, in the Region of Waterloo, in relation to all disputes arising from or related to these Terms, your use of the Site and/or Services and any related matters.
Termination: The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms for all purposes.
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us at the contact information set out above that you no longer wish to use our Services, or when you cease using our Site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate these Terms, with or without cause, at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
No waiver: No waiver of any breach of these Terms shall operate as a waiver of any subsequent breach or the breach of any other provision of these Terms. No provision of these Terms shall be deemed to be waived, and no breach excused, unless such waiver or the consent excusing the breach is in writing and signed by us. GRT reserves the right to waive any portion of these Terms at any time in its sole and absolute discretion, without such waiver constituting a continuing waiver.
Entire Agreement: These Terms and any policies or operating rules posted by us on this Site or in respect to the Services constitutes the entire agreement and understanding between you and us and govern your use of the Site and the Services, and supersedes any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Independent Contractor: We will perform our obligations under these Terms as an independent contractor. Nothing herein will be construed to place us or you in a relationship of principal and agent, partners or joint ventures, and neither us nor you will have the power to obligate or bind the other in any manner whatsoever.
Successors and Assigns: The Terms are binding upon you, your heirs, executors, beneficiaries, successors and assigns.
Headings: The headings used in the Terms are included for convenience only and will not limit or otherwise affect these Terms.
